These Terms and Conditions apply to your use of thinkpod.co.in (the "website") and to any enquiry, quotation, purchase or rental of ThinkPod acoustic office pods (the "products") made through it. By using the website or placing an order, you agree to these terms. If you do not agree, please do not use the website.
In these terms, "we", "us" and "our" mean Thinkpod, and "you" means the person or business using the website or buying or renting our products.
We take care to describe our products accurately. Images, dimensions, colours and finishes shown on the website are for illustration and may differ slightly from the delivered product.
Sound reduction figures (for example, up to 30 dB (±5) at a sound level of 100 dB) are measured under controlled conditions. Actual performance depends on the site, the surrounding noise, door use and installation conditions.
We may improve or change product specifications, materials or components without notice, as long as the change does not materially reduce the product's performance.
All prices shown on the website, including buy prices, rental prices and calculator estimates, are indicative only and do not form an offer.
Unless stated otherwise, prices exclude GST, freight, installation and other applicable charges. A formal written quotation will set out the final price for your configuration, quantity and location.
Quotations are valid for the period stated on them. We may revise a quotation if your requirements, the site conditions or applicable taxes change.
An order is confirmed only when we accept it in writing (including by email) and receive any advance payment stated in the quotation or proforma invoice.
Payment terms, milestones and accepted payment methods will be set out in the quotation or invoice. We may hold dispatch or installation until payments due at that stage are received.
Ownership of purchased products passes to you only after full payment is received.
Lead times shown on the website are typical estimates and not guaranteed dates. We will share an expected delivery and installation schedule when your order is confirmed.
You are responsible for making the site ready before installation, including a clear, level floor area, access for delivery (door widths, lifts and stairs), a suitable power supply and any building or landlord permissions you require.
If installation is delayed because the site is not ready or access is not available, additional charges for storage, revisits or extra labour may apply.
Please inspect the products at delivery and report any visible damage or shortage in writing within 48 hours.
Rental of ThinkPods is governed by a separate rental agreement, which will set out the tenure, monthly rent, deposits, maintenance, relocation, insurance and end-of-term options. If anything in these terms conflicts with your rental agreement, the rental agreement applies.
Rented products remain our property at all times. You must use them with reasonable care, keep them at the agreed location, and not modify, sub-let or move them without our written consent.
Customised products (including special finishes, colours, branding, sizes or configurations) are made to your approved specification. Once production of a customised product has started, the order cannot be cancelled or changed without our agreement, and charges for work already done may apply.
You may cancel a confirmed order only with our written agreement. Advance payments may be adjusted against costs already incurred, including materials, production, freight and handling.
Because our products are made to order, we do not accept returns of products that are delivered in good condition and as per the agreed specification.
Our products come with the service support or warranty stated in your quotation, invoice or rental agreement.
Support does not cover damage caused by misuse, accidents, unauthorised modification or repair, relocation not carried out by us, electrical faults at the site, or normal wear and tear of consumable parts.
To raise a support request, contact us with your order details and a description of the issue.
You may use the website only for lawful purposes. You must not attempt to disrupt the website, gain unauthorised access to it, or copy its content for commercial use without our permission.
Enquiry forms on the website open your email app to send your details to us. Please make sure the information you send is accurate.
All content on the website, including text, images, product designs, graphics and logos, belongs to us or our licensors. You may not reproduce, distribute or use it without our written permission.
We use the details you share with us (such as your name, company, phone number, email and city) only to respond to your enquiry, prepare quotations and proposals, and provide our products and services. We do not sell your personal information.
To the extent permitted by law, we are not liable for any indirect or consequential loss, loss of profit or loss of business arising from the use of the website or our products.
Our total liability for any claim relating to an order is limited to the amount you paid for the products concerned.
We may update these terms from time to time. The version published on this page, with its "last updated" date, applies from the date it is published.
These terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts at Gautam Buddh Nagar, Uttar Pradesh.
